1) Scope & Who This Covers

This Policy applies to personal information we collect through our websites, newsletters, emails, SMS/push (if you opt in), communities, and related services (collectively, the “Service”).

This Policy does not apply to:

  • Workforce/job applicant data (covered by separate notices);

  • Information we process solely as a service provider/processor for another business; or

  • Third-party websites, apps, or services linked from the Service.

The Service is intended for U.S. residents age 18+ and is not directed to children under 13.


2) Information We Collect

We collect information directly from you, automatically, and from third parties.

A. Information You Provide

  • Identifiers & contact data: name, email, phone number (if you opt into SMS), mailing address (if provided).

  • Account & subscription data: username, preferences, communication settings.

  • Payment & transaction data: last four digits of card, card type, billing address, transaction history (full card numbers are handled by our payment processor and are not stored by us).

  • User content: comments, survey responses, messages to us, support requests.

  • Marketing choices: opt-ins/opt-outs for email, SMS, push, cookies.

B. Information Collected Automatically

  • Device & usage data: IP address, device identifiers, browser type, operating system, referring pages, timestamps, pages viewed, clicks, approximate location (derived from IP).

  • Cookies & similar technologies: to remember settings, measure performance, prevent fraud, and (where permitted) for analytics and advertising.

C. Information from Third Parties

  • Service providers & vendors: payment processors, analytics, anti-fraud, customer support platforms.

  • Platforms you connect: if you access us via a platform (e.g., newsletter platform, app store), we receive the data they share under their terms.

  • Public & commercial sources: to supplement accuracy (e.g., address normalization) and detect fraud/abuse.


3) How We Use Information (Purposes)

We use information to:

  1. Provide the Service (accounts, content delivery, customer support).

  3. Communicate (service messages, newsletters, alerts; SMS/push only if you opt in).

  • Service providers/contractors (e.g., hosting, email/SMS delivery, payment processing, analytics, customer support, anti-fraud), bound by confidentiality and limited-use obligations.

  • Business partners when you intentionally interact with them (e.g., a co-branded webinar you sign up for).

  • Legal, compliance, and safety (to comply with law, lawful requests, protect rights, safety, property, or investigate fraud/security events).

  • Corporate transactions (merger, acquisition, financing, or sale of assets; your information may be transferred as part of the transaction).

  • With your consent or at your direction.

We may share de-identified or aggregated data that does not identify you.


5) Cookies, Analytics, and Advertising

We and our partners use cookies and similar technologies to operate the Service, measure performance, and (where permitted) support analytics and interest-based advertising. You can control cookies via your browser settings and the cookie banner (where shown). Some states grant additional rights to opt out of “sales” or “sharing” (see Section 8).
Do Not Track: We do not respond to DNT signals, but we honor applicable state Global Privacy Control (GPC) signals for opt-out of sales/sharing where required.


6) SMS/Texts (If You Opt In)

By providing a mobile number and opting in, you consent to receive automated texts about the Service (message frequency varies). Message/data rates may apply. Text STOP to opt out; text HELP for help. We may use a compliant A2P number. Your opt-in is not a condition of purchase. We may use third-party SMS providers to send messages.


7) Data Security

We use reasonable administrative, technical, and physical safeguards to protect personal information. However, no method of transmission or storage is 100% secure. You are responsible for safeguarding your account credentials and promptly notifying us of any unauthorized use.


8) U.S. State Privacy Rights (CA, CO, CT, DE, IA, IN, MT, OR, TN, TX, UT, VA, and others)

Depending on your state, you may have rights to access, confirm, correct, delete, receive a portable copy, and opt out of certain processing (including targeted advertising, “sale,” or “sharing” of personal information, and some profiling). You also have the right to be free from discrimination for exercising these rights.

  • Verification: We may verify your identity (e.g., by confirming control of your email/phone or requesting limited additional info).

  • Authorized Agents (CA): Agents must provide proof of authorization and we may still verify your identity.

  • Appeal (e.g., VA/CO/CT/DE): If we deny your request, you may appeal by replying to our decision within 45 days; unresolved appeals may be raised to your state AG.

“Sale”/“Share” Opt-Out & Targeted Advertising

Some states define “sale” or “share” broadly to include certain analytics/advertising uses of cookies. Where required, you can opt out by:

  • Using our Your Privacy Choices link (if available in the footer);

  • Adjusting cookie preferences in our banner; and/or

  • Enabling a recognized GPC signal in your browser (we treat it as an opt-out where required).

Sensitive Personal Information (SPI)

We do not seek to collect SPI (e.g., precise geolocation, financial account log-ins, SSN). If we process SPI (for example, limited payment identifiers handled by our processor), we limit use to permitted purposes (e.g., provide the Service, prevent fraud, or comply with law).

California “Notice at Collection” (CPRA)

Categories collected: identifiers, commercial information, internet/electronic activity, inferences (for personalization), and limited financial/billing data via our processor.
Purposes: as described in Sections 3–5.
Retention: We keep information for as long as needed for the purposes described (see Section 10).
Selling/Sharing: We may be deemed to “sell” or “share” personal information for cross-context behavioral advertising as defined by CPRA; you can opt out as described above.
Non-discrimination: We will not discriminate against you for exercising CPRA rights.
Financial Incentives: If we offer a program that provides benefits (e.g., referral bonuses or discounts) in exchange for personal information, participation is optional; we will present terms describing categories of PI involved, how to opt in/out, and a good-faith value of the data.

Nevada

Nevada residents may opt out of the “sale” of covered information by emailing privacy@growyourpile.com.


9) Children & Teens

The Service is not directed to children under 13, and we do not knowingly collect their personal information. If you believe a child under 13 has provided information, contact us and we will delete it.
For teens 13–16 in applicable states (e.g., CA), we will not “sell” or “share” personal information without required consent.


10) Retention

We retain personal information for the periods necessary to provide the Service, comply with legal obligations, resolve disputes, enforce agreements, maintain business records, and for other legitimate purposes described in this Policy. Criteria include the nature of the data, the purposes for which it is used, and applicable legal/operational requirements. When no longer needed, we take steps to de-identify or delete the data.


11) Your Choices

  • Email marketing: Use the unsubscribe link in our emails or adjust preferences in your account.

  • SMS: Text STOP to opt out.

  • Cookies/Ads: Use browser settings, our cookie banner, and “Your Privacy Choices” (where provided).

  • Do Not Track: See Section 5; we honor GPC where required.


12) Payment Processing

Payments are processed by third-party providers (e.g., card processors or app stores). We do not store full payment card numbers. Your use of a third-party checkout is governed by that provider’s terms and privacy policy.


13) De-Identified & Aggregated Data

We may create and use de-identified or aggregated information for research, analytics, and service improvement. We commit to maintaining and using de-identified data without attempting to reidentify it, except as permitted by law.


14) International Users

The Service is controlled from the United States and is intended for U.S. residents. If you access the Service from outside the U.S., you understand your information may be processed in the U.S., where laws may differ from those of your jurisdiction.


15) Changes to This Policy

We may update this Policy from time to time. The Effective Date will reflect the latest revision. Material changes will be highlighted (e.g., on our site or via email). Your continued use after the Effective Date means you accept the updated Policy.

We implement reasonable measures to protect personal information and comply with applicable U.S. state privacy laws; however, the internet has inherent risks. Use of the Service is at your own risk and is subject to our Terms of Service (including limitations of liability and dispute resolution in Delaware).
